General conditions for the sale of Gift Cards

General conditions for the sale of Gift Card

  1. For the purposes of the interpretation and application of these General conditions, the expressions below shall have the following meaning:

    • ATP Tour: means the professional men's tennis circuit managed by the English body ATP Tour, Inc.;

    • Events: means edition 2021 of sports event called i)Internazionali BNL d'Italia, ii)Nitto ATP Finals e iii)Next Gen ATP Finals;

    • Final User: means the User who completed the activation process of the Gift Card on one of the Website (i.e. the process of association of a User's profile with the code of a Gift Card), in order to use the Gift Card to purchase Tickets or Season Tickets on one of the Websites.
    • General conditions : means these General conditions, published on the Websites;

    • Gift Card: means a voucher of predetermined value, associated with a code, which can be purchased on one of the Websites and subsequently used by the User to purchase, even collectively, Tickets and Season Tickets for one or more Events, by the date indicated in the Gift Card itself;

    • Internazionali BNL d'Italia: means sports event in which, on the basis of the ranking assigned by the ATP (Association of Tennis Professionals) and the WTA (Women's Tennis Association), two tournaments are held, respectively reserved for male and female players, organized in a main draw ("Main draw"), in a qualifying draw for the Main draw ("Qualifying draw") and in a draw for the final stages of pre-qualification for the Qualifying draw;

    • Matches: means the individual tennis matches that will be played as part of the Events;

    • Next Gen ATP Finals: means the tennis event reserved for the best players of the ATP Tour who are maximum 21 years of age;

    • Nitto ATP Finals: means the tennis event reserved for the best players of the ATP Tour;

    • Purchaser: meansthe User who purchased the Gift Card on one of the Websites with payment by bank transfer or credit card;

    • Privacy Policy: means the privacy policy provided by FIT pursuant to Article 13 of Regulation EU N. 679/2016 and published on each of the Websites, which is deemed to be referred to in full herein;

    • Season Ticket: means the carnet of Tickets, which may also be issued electronically, that allows its holder to access the Venue and to attend Training (where applicable) and Matches to be held as part of the Events on the date and sessions indicated thereon;

    • Ticket: means the admission ticket, which may also be issued electronically, that allows its holder to access the Venue and to attend Training (where applicable) and Matches to be held as part of the Events on the date and sessions indicated thereon;
    • Training: means any sports preparation sessions carried out by participating athletes: i) in the days prior to the holding of the Qualifying draw matches within the Internazionali BNL d'Italia; ii) in the days prior to the holding of the Matches within the Nitto ATP Finals and Next Gen ATP Finals;
    • Website ATPF: means the website dedicated to the purchase of Tickets and Season Tickets for the 2021 edition of the Nitto ATP Finals, available at https://tickets.nittoatpfinals.com, where you can also purchase the Gift Card;
    • Website IBI: means the website dedicated to the purchase of Tickets and Season Tickets for the 2021 edition of the Internazionali BNL d'Italia, available athttps://ticketing.internazionalibnlditalia.com, where you can also purchase the Gift Card;
    • Website Next Gen: means the website dedicated to the purchase of Tickets and Season Tickets for the 2021 edition of the Next Gen ATP finals, available atticketing.nextgenatpfinals.com, where you can also purchase the Gift Card;

    • Websites: means, collectively, Website ATPF, Website IBI and Website Next Gen;

    • User : means any individual who made a registration on one of the Websites.

  2. These General conditions, published on the Websites, regulate the sale and use of the Gift Card.

  3. By purchasing the Gift Card, the Purchaser and the Final User declare to have fully understood and accepts the provisions of these General conditions and acknowledges to have read and understood the Privacy Policy published on relevant Website.
  4. When purchasing the Gift Card the Purchaser receive, by sending to the e-mail provided when registering on one of the Websites, the code for using the Gift Card. The Purchaser shall be responsible for keeping the code and to prevent third parties from illegally using it by carrying out the activation procedure referred to in point 6 below; in this regard, the Purchaser accepts that knowledge of the code for using the Gift Card by third parties will allow to third parties to use the Gift Card in their name.
  5. The Purchaser may become the Final User or may give the Gift Card to another User.
  6. A User who wishes to purchase Tickets or Season Tickets for one or more Events shall complete the Gift Card's activation process on one of the Website by associating his profile with the code of the Gift Card received by the Purchaser via e-mail.
  7. Once activated, the Gift Card cannot be given to another User.
  8. The Gift Card allows to purchase Tickets and Season Tickets on one of the Websites and only on or before the Gift Card's expiry date. By purchasing Tickets or Season Tickets on one of the Websites, the Final User accepts the general conditions for the sale of tickets and the entrance of venue where the Event will take place, published on the relevant Website.
  9. It is not possible to use a Gift Card in order to purchase another Gift Card.
  10. If the value of the Gift Card is equal to the amount of the purchase order for Tickets and Season Tickets, the entire value of the Gift Card will be zeroed once this purchase order has been made and it cannot be used further.
  11. If the value of the Gift Card is lower than the amount of the purchase order for Tickets and Season Tickets, the entire value of the Gift Card will be zeroed once this purchase order has been made and it cannot be used further. The difference can be paid by the Final User exclusively by credit card or by using another Gift Card with sufficient amount.
  12. If the value of the Gift Card is greater than the amount of the purchase order for Tickets and Season Tickets, the value of the Gift Card will be decreased by an amount equal to the amount of the relevant purchase order. The residual value of the Gift Card can be used exclusively in order to the purchase other Tickets or Season Tickets.
  13. Any personal data provided by the Purchaser upon purchasing the Gift card and by the Final User at the time of activation of the Gift Card shall be true, accurate, valid and complete and will be processed by FIT only and exclusively by the modalities and for the purposes indicated in the Privacy Policy published on relevant Website.
  14. FIT reserves the right to amend these General conditions, taking care to notify such amendments by means of a specific notice published on the Websites. The amendments shall be effective to commence on said publication, or on a different date specified in the same notice. The amendments consequential to statutory or provision amendments of the public authority shall be effective regardless of the publication of the notice on the Website.
